David practises intellectual property law and is qualified as a Patent Attorney Litigator, British and European Patent Attorney and British and European Trade Mark Attorney. He received his Batchelor of Science in Applied Physics and Chemistry from the University of Durham in 1991 and obtained industry experience in the central polymer research labatoratories of Hoechst AG in Frankfurt, where he also perfected his technical German.
David's practice encompasses a broad range of electronic, mechanical, chemical and software technologies including automotive applications, telecommunications and railway technology. David is also very active in trade mark matters and has been responsible for the management of a number of large trade mark filing programmes of trade marks in over 100 jurisdictions. He also is responsible for the management of several large trade mark portfolios around the world.
David also counsels generally in IP matters including designs and copyright and has advised on the IP aspects of a number of corporate acquisitions and disposals.
As a Patent Attorney Litigator, he not only undertakes the drafting and prosecution of intellectual property rights but also conducts litigation to enforce these rights before the High Court and Patents County Court in addition to opposition work at the EPO and UKIPO.
His recently reported cases include:
- DaimlerChrysler v. Alavi [2001] RPC 42 (Pumfrey J. Registered & Community trade marks infringement and validity) .
- Tripp Ltd v Landor & Hawa Intl Ltd [2004] All ER (D) 270 (Ch). A High Court dispute concerning design right infringement, trade mark infringement and international domain name and trade mark squatting. Successful defence of security for costs application of highly geared company.
- Ghazilian's Application [2001] RPC 33 . An appeal before the Appointed Person concerning the morality of an application for a registered trade mark.
- CARSMART [2005] ETMR 93. Successful appeal concerning the use of the SMART trade mark and registrability of retailer marks for goods.
